  • the assault must be reported to the police without any delay
  • the value of the pain and suffering must exceed £1,000
  • a claim form must be submitted within two years of the assault
  • RTA offences are excluded unless a vehicle is used as a weapon

  • the recovery period must exceed six weeks
  • the victim must not have provoked the assault
  • unspent previous convictions for violent offences are considered
